If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use (“Terms”) which govern our relationship with you in relation to this website. Any purchase of goods made through this site will be subject to these Terms. If you disagree with any part of these Terms, please do not use our website.

The term “we” means Uncommon Projects Ltd the owner and operator of the website www.uncommonprojects.co.uk (the “Website”) whose registered office is Unit 4, Mentmore Studios, 11 Argall Avenue, London E10 7QE and company registration number is 07544648 (references to “Uncommon Projects”, the “Company”, “us” and “our” mean Uncommon Projects Ltd).

The term “you” or the “customer” refers to the customer, user or viewer of our Website.

This Website uses cookies. By using this Website and agreeing to these Terms, you consent to our use of cookies in accordance with the terms of our cookies policy and you agree to the use of your information in accordance with our Privacy Policy.

Placing an order
The price of our products will be displayed in GBP and transactions will be made in that currency.

We are not obligated to accept your order and reserve the right to refuse or cancel any order once it has been placed. This may be done, for example, if:

– your payment is not authorised or has been marked as fraudulent, or potentially fraudulent, by the payment system;
– payment has been made using a card not issued in a country we dispatch to, or not where the billing address is;
– there is an error on the website regarding the price or description of a product; or
– if you have requested a bespoke product and it is not possible for any reason to carry out the work requested.

By placing an order with us you are confirming that any information you have given is true and accurate and that you are authorised to use the card on which payment was made.  We are not responsible for any delay resulting from an inability to validate or authorize your payment.

We are not liable for any breach of agreement, for delay or failure to perform if the delay or failure is due to acts of God, civil commotion, riots, floods, drought, fire, legislation or other cause beyond our reasonable control. This does not affect your statutory rights.

Our products
All products are subject to availability, which is subject to change. Images of products shown on the Website, and colours shown on screen, are reproduced as accurately as our electronic processes allow, but may not always represent the exact image or colour of the final product. The specifications of timber, stains, fixings, finishes and other goods may also be subject to change over time. Due to the nature of some of the timbers and finishes used there will also be natural variations in colour and surface markings. No guarantee is given that the furniture supplied will be an exact replica as appearing on the Website and the Company will not accept returns or claims of any sort on this basis.

We reserve the right to amend the details and specifications of our products as necessary, or to conform with any changes in UK or EU requirements.
We try to ensure that information regarding products on our website is as accurate as possible. However, we cannot be held responsible for any inaccuracies or errors which appear on the Website.

Prices
All prices are in pounds sterling and include VAT at the prevailing rate.

The prices shown on our product listings do not include delivery. Additional delivery charges will apply and will be shown separately itemised on your shopping cart prior to checkout.

Prices are subject to change. However, in the event of a change in prices, these will not affect any order which has been placed and agreed.

Delivery
Delivery services are provided by a third party delivery service provider. Uncommon Projects are not liable or responsible for the acts or omissions of the delivery service.

Delivery will be made to the address you have provided to us. It is your responsibility to ensure that there is an adult available at the address to sign for and receive the products. Delivery will be made to the ground floor entrance of the premises only. Please contact us if you require a different level of service. It is the customer’s responsibility to ensure any furniture can fit through doorways or staircases, where applicable.

Responsibility for the goods will pass to you upon delivery. The customer should inspect the goods on receipt. Any damage or faults with the item should be written on the delivery paperwork at the point of delivery. Once goods have been delivered and signed for the customer is responsible for any damage or loss of parts.

Please let us know of any scaffolding or temporary structure which may impede delivery. We reserve the right to refuse delivery where, in our reasonable opinion, it would put our delivery personnel at risk. An example of such a situation would be where delivery of a heavy piece of furniture is requested over part of a building site.

We make every effort to deliver your goods within the expected timetable. However, delays sometimes occur due to unforeseen circumstances. Time is not deemed to be of the essence of the contract and the Company accepts no liability for any losses, costs, damages or expenses incurred by you or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.

Cancellation and Amends
If you wish to cancel or amend an order you should do so in writing by sending an email detailing your order number, contact details and requirement to info@uncommonprojects.co.uk or by phoning +44 (0) 20 8617 1554. We will endeavour to fulfil you request.  However, if your order is bespoke and has already started you will be charged a reasonable sum for the costs incurred.

Ex-display Items
We may sell some ex display or clearance items. These items may have some damage or parts which are missing. We will endeavour to inform you of any such defects, but otherwise these items will be sold ‘as seen’.

For security reasons, refunds are given by the same method that the original payment was made by.

Returns policy
If any products you order from us are bespoke, made-to-order products you will not be covered by the Distance Selling (The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013) (the “Distance Selling Regulations”), which means that you are not entitled by law to a refund, unless the products are defective. Cancellation of Orders in such cases will therefore only be accepted if the Company has agreed in writing to such cancellation and on condition that you reimburse the Company all costs and expenses or losses and damages resulting from the cancellation.

If you purchase appliances from the Company or goods which are not made bespoke, and you are a consumer as defined in The Distance Selling Regulations, you have the legal right to cancel your order up to 14 calendar days after the day on which the contract is entered into.  You will be given a full refund minus the original delivery fee. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty. If your products have already been delivered to you, you will however be required to return them at your own cost and in good saleable condition (which means in their original packaging). In the event of any damage to the goods or their packaging, the Company shall be entitled to deduct a reasonable amount to compensate the loss in sales value of such items.

We recommend you use insured and/or registered post and keeping the proof of postage as we cannot be responsible for goods lost or damaged in transit.

Wood finishes
We use high-quality furniture grade veneers and plywood. However, as a natural product this can vary in grain, colour, knots and other markings.  We cannot accept returns based on natural variations.  If you have a special requirement for the wood finish please contact us prior to placing the order.  

Wood can have dimensional changes depending on the temperature, humidity and moisture present. This can lead to warpage and shrinkage issues. We cannot accept returns based on the furniture being stored in usual conditions and this causing damage to the product.  However, please note most movement can usually be rectified by fixing the temperature or moisture issues in the environment.

Use of our Website
Unless otherwise stated, Uncommon Projects owns the intellectual property rights in the website and material on the website. Subject to the license below, all these intellectual property rights are reserved.

You may view website pages, download website pages and print website pages for your own personal use, subject to the restrictions set out below and elsewhere in these Terms.

You must not use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You must not use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of malicious computer software.

You must not use our website to transmit or send unsolicited commercial communications.

You must not use our website for any purposes related to marketing without our express written consent.

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics.

You are granted a licence to use the material contained in this website subject to the restrictions described in these Terms.

You are granted a licence to download, store, view, edit, use, reproduce, copy, print, any material contained in this website for your own personal and/or business purposes.

You are not permitted to:

– republish material from this website (including republication on another website, except in the case of social media such as Facebook and Twitter in which case you are permitted to publish extracts in order to promote use of the Website);
– sell, rent, license, sublicense, lease, distribute, copy, duplicate, publish or reproduce material from the website and any material or any part thereof for use by any third party;

If you breach these Terms in any way then the licence granted to you will be automatically terminated upon such breach and Uncommon Projects may take such action as we deem appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

We reserve the right to exclude any person from using this website and material contained therein where a breach of these terms & conditions is suspected.
You must retain, and must not delete or remove all copyright notices and other proprietary notices placed by us on any material.

User Content
Our Website may permit users to submit reviews and, in the future, may allow posting images, videos or other content by you and other users ("User Content") and the hosting and publishing of such User Content. You understand that whether or not such User Content are published, we do not guarantee any confidentiality with respect to any User Content.

Nothing in these Terms will limit or exclude our or your liability for death or personal injury resulting from negligence; limit or exclude our or your liability for fraud or fraudulent misrepresentation; limit any of our or your liabilities in any way that is not permitted under applicable law; or exclude any of our or your liabilities that may not be excluded under applicable law.

By using this website, you agree that the exclusions and limitations of liability set out in these Terms are reasonable. If you do not think they are reasonable, you must not use this website.

Indemnity
If you breach these Terms you will be held fully responsible for any loss suffered by Uncommon Projects as result of such breach and will be held accountable for all profits made from breaching these Terms.
